Product

Follow the care instructions provided with the garment.

Care instructions are included on the product label located on the inside of most garments. Specific instructions provided by the manufacturer of technical fabrics should be followed in addition to the instructions we provide. We recommend following these instructions in order to maximize the garment's performance and lifespan.

Prepare your garment for washing.

We recommend turning garments inside out, closing all zippers, emptying all pockets, and sealing all openings before washing. Again, please follow the wash instructions that came with your garment.

Consider using specialty cleaning products made for technical fabrics.

There are a variety of specialty cleaning products designed for washing technical fabrics. These products leave little-to-no residue, which can be a problem with traditional laundry detergents.

Durable Water Repellent (DWR)

Most of our waterproof and water-resistant garments are treated with a Durable Water Repellent (DWR) coating. Over time this coating needs to be replenished as the garment is exposed to use and washing. If your product no longer beads up when exposed to water it is a good indication that it is time to treat your garment with a DWR finish.

There are many good DWR products on the market available for purchase. We recommended McNett Revivex Durable Waterproofing Spray. As a general rule, we recommend using a spray-on DWR treatment when you wish to reapply the treatment in between washes. Wash-in DWR treatments are recommended when laundering your garment.

We urge you to spot clean before applying DWR. Be sure to target seams and high-impact areas when applying. For the best results, we suggest hang drying your garment.

D3O® Protective Pad Care

D3O® products should be stored at room temperature, in a ventilated dry place out of direct sunlight. Do not store under heavy objects. If wet after use, ensure your D3O® product is dried before storing. Never fold your D3O® products.

If applicable, D3O® protectors should be removed carefully from the garment before washing. D3O® protectors should be wiped clean using a damp cloth. NEVER use cleaners or detergents to launder your D3O® products.

Do not attempt to cut, reshape, or modify any part of your D3O® product. If your D3O® protector has sustained a significant blunt impact, it should be discarded and replaced.

All of our products are designed at our headquarters in Los Angeles, but they are manufactured all over the world. Currently, we work with factories in China, Vietnam, Indonesia, Portugal, and the Philippines.

Our decision to move a portion of our production overseas was made with great reluctance. We'd love to do all of our manufacturing in the US and would happily pay a premium to do it. However, to date, we've been unable to find a US manufacturer capable, or even willing, to take on the highly technical garments we make. The skilled workforce and advanced machinery to do so have moved overseas many years ago, long before we started AETHER. Quality is our absolute top priority. We are unwilling to compromise the integrity of our products in exchange for country of origin. Location will always be a consideration when selecting factories. However, our focus will remain on finding manufacturers that have socially responsible practices, the most skilled workers, advanced machinery, and technical expertise.

AETHER offers customers a guarantee that our products will stand up to the rigors for which they were intended. All AETHER products (excluding knits, footwear, and sunglasses, and the exceptions listed below) are backed by a manufacturing warranty, which we extend to the original owner in order to safeguard against any and all defects in workmanship and material.

Unfortunately, despite our best efforts, no piece of clothing can, or ever will, last forever. Therefore, our manufacturing warranty applies only to a reasonable expectation of the product’s lifetime. This period of time is different for each product and is subject to our discretion.

Zippers are not included in the warranty coverage of our products. Additionally, damages due to normal wear and tear, such as rips, tears, abrasions, UV degradation, misuse, neglect, or natural breakdown of materials over time, are in no way covered under this warranty.

IF YOUR DAMAGE FALLS IN ONE OF THE BELOW “NORMAL WEAR AND TEAR” CATEGORIES, IT WILL NOT BE ELIGIBLE FOR A REPAIR/REPLACEMENT.

However, if you truly suspect that a product has failed prematurely due to poor workmanship or a defect in materials used, then we encourage you to submit it to our customer service team for review.

Your request will be inspected by our Quality Control department to determine if a replacement or repair will take place. You will be notified with a decision as soon as your case is reviewed. If the item falls outside of our warranty, we may still repair but at the customer's cost for repair and shipping. All replacements and/or repairs are at our discretion.

If you have a warranty claim on an item that is out of stock, you will be eligible for store credit in the amount of the item’s current price. (If the item was bought on sale, you will be eligible for store credit in the amount of the sale price.)

Please note, if your warranty claim qualifies for a replacement and/or store credit due to impossibility of repair, we will not return garments submitted for warranty.

Customers are responsible for shipping items to AETHER for warranty evaluation. California State law requires that all items being submitted for review be cleaned, in accordance with the product’s wash instructions, before being sent. Our customer service team sincerely appreciates your cooperation. If it is determined that your product needs to be cleaned upon arrival, it will be returned to you.

Our typical turnaround time is 6 to 8 weeks from the time we receive your product until it is returned to you. In rare cases, this process may take longer. For further questions, please contact hello@aetherapparel.com.

Shipping

Domestic

Orders received before 11 a.m. PST ship the same day. Orders received after 11 a.m. PST, on weekends, on holidays, or that need to be sent from one of our store locations are processed the next business day. Orders that qualify for free overnight shipping will be processed in according to our normal process. Orders are shipped through FedEx; express options are available for additional fees. Once an order is shipped, you will receive an email with a tracking number. This will give you the best time estimate for when your package will arrive. Tracking may take up to 48 hours to update.

International

AETHER offers international shipment through FedEx. International orders are processed from our warehouse in Los Angeles within 48 hours of being received, Monday through Friday. Once an order is shipped, you will receive an email with a tracking number. This will give you the best time estimate for when your package will arrive. Tracking may take up to 48 hours to update.

Sale Period

Domestic and international orders will ship out with the requested ship method, however, please allow for additional time for processing due to high volume.

Returns & Cancellations

AETHER products can be returned or exchanged up to 30 days after date of purchase for a refund providing the item is in its original condition, with tags still attached. Eligible products purchased online may be returned or exchanged at any AETHER retail location. Due to logistical constraints, we are unable to accept returns for any third-party item sold through our website or in-store. We also do not accept returns on eyewear. Third-party items and eyewear are all final sale.

For returns on domestic orders, we offer flat rate FedEx shipping labels. Most returns are $7; however, returns including footwear are $15. This is often less expensive than the typical cost to mail an item back yourself.
Returns for exchange or store credit are free. You can also return your item(s) to one of our retail stores for no extra cost.

US RETURNS / EXCHANGES

If you would like to return or exchange an item, please visit AETHER RETURNS to initiate the request and receive a prepaid shipping label. Once your return is processed, you will be sent an email notifying you that your return has been completed. Most returns are processed within one week of being received. Refunds should take between 1-5 days to post to your account.

CANADA & INTERNATIONAL RETURNS / EXCHANGES

Due to constantly changing duties and tariffs, we are unable to offer prepaid shipping labels for international returns at this time. The customer is responsible for shipping the item back, including any fees that may apply. We encourage you to use a carrier that provides a tracking number. Without this, we can’t honor a refund or exchange on a missing package.

If you are making an exchange, we will cover the cost of shipping the new item to you.

ELIGIBILITY. The Aether Apparel Giveaway (the “Sweepstakes”) is only open to legal residents of the United States and the District of Columbia, who are of legal age of majority in the jurisdiction in which they reside (and at least 18 years old) at the time of entry. Void outside United States and District of Columbia and where prohibited or restricted by law, rule or regulation. Employees of Aether (the “Sponsor”) and its respective affiliates, subsidiaries, advertising or promotion agencies are not eligible, nor are members of these employees’ families (defined as parents, children, siblings, spouse, and life partners). Proof of residency and age may be required. The Sweepstakes is subject to all applicable federal, state, and local laws, rules and regulations.

HOW TO ENTER. Persons who are currently on Sponsor’s email mailing list are automatically entered to win. For those not already on Sponsor’s email mailing list, you may enter in one of two ways: (1) submit your email online at www.aetherapparel.com; or (2) by visiting an Aether store location, filling out a customer information card and leaving it with an Aether associate. ONLY ONE ENTRY PER PERSON REGARDLESS OF METHOD OF ENTRY. Entries shall be the property of the Sponsor and will not be returned for any reason.

Sponsor, or its respective affiliates, subsidiaries, advertising or promotion agencies are not responsible for lost, late, incomplete, garbled, illegible, or misdirected Sweepstakes entries, or for any error, human, technical or otherwise, which may occur in the processing of Sweepstakes entries. In order to accept a prize, entrants shall be required to sign a release that grants permission to the Sponsor to use his or her name, photograph, likeness, prize information and/or biographical information without future compensation unless prohibited by law. By entering, participants release and hold harmless the Sponsor, its respective parents, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, loss or damages of any kind arising from or in connection with the Sweepstakes, Sponsor’s website, or any prize won.

AGREEMENT TO OFFICIAL RULES. Participation in the Sweepstakes constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and Sponsor’s Privacy Policy at http://www.aetherapparal.com/privacy and to be contacted by telephone and/or email. Odds of winning depend on the total number of eligible entries received. Limit one (1) prize per person, family and per household.

SELECTION OF POTENTIAL WINNER. Four (4) winners will be selected during the Promotion Period. One (1) winner (“Winner”) will be selected at random each calendar quarter on or about the following dates: January 15, 2017, April 15, 2017, July 15, 2017 and November 15, 2017. Winner will be contacted within ten (10) days of selection. Sponsor’s decisions as to all matters related to administration of the Sweepstakes and selection of Winner are final. Potential Winner must comply with all terms and conditions set forth in these Official Rules, and winning and award of prize is contingent upon fulfilling all requirements. If a potential winner cannot be contacted within twenty-four (24) hours after the first attempt to contact such potential winner, an alternate entrant will be selected in his or her place at random from all eligible entries received.
PRIZES. One (1) Prize is available to be awarded per Winner. Each Winner will receive a one thousand dollar ($1,000) Aether gift certificate (the “Prize”) which may be redeemed at any Aether store or at www.aetherapparel.com. Winner is fully responsible for any and all applicable federal, state, and local taxes (including income and withholding taxes). All costs and expenses associated with Prize acceptance and use not specified herein as being provided are the sole responsibility of Winner. All prize details are at Sponsor’s sole discretion. Winner’s guest must be of legal age of majority in their jurisdictions of residence.

The Prize is non-transferable and non-assignable, with no cash redemptions or substitutions except at Sponsor’s sole and absolute discretion. Sponsor reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value, at its sole and absolute discretion.

RESTRICTIONS. The Winner is fully responsible for any and all applicable federal, state, and local taxes (including income and withholding taxes). Except where otherwise expressly noted in these Official Rules, the selection of all vendors, prizes, products and services is subject to the Sponsor’s sole and absolute discretion. Prize (and/or any portion thereof) is nontransferable and non-exchangeable. No substitutions or cash redemption of prize is permitted except that Sponsor retains the right to substitute a prize of equal or greater retail value (or at Sponsor’s election, the cash value of the applicable prize). Additional restrictions may apply.

All federal, state and local taxes related to the Prize are the sole responsibility of each Winner. All other expenses and costs not expressly listed above are Winner’s sole responsibility. No refunds or credit for changes are allowed. No transfer of the prize is permitted. Winner must execute and return to Sponsor an Affidavit of Eligibility/Release of Liability, Publicity and W9 within five (5) days of receipt from Sponsor. Winner’s guest shall be required to execute and return an Affidavit of Eligibility/Release of Liability, Publicity within five (5) days as well. Noncompliance within this time period may result in disqualification, and an alternate winner may be selected if time allows. Return of any prize notification as undeliverable may result in disqualification and selection of an alternate winner.

GENERAL CONDITIONS. The Sweepstakes is governed by the laws of the United States and the State of California, excluding conflicts of laws principles. All federal, state and local laws and regulations apply. Sweepstakes void where prohibited. Sweepstakes may only be entered in or from United States and entries originating from any other jurisdiction are not eligible for entry.

Except where prohibited by law, Winner and guest grant to Sponsor and its advertising agencies the right to use and publish Winner’s and Winner’s guest’s photo, proper name, likeness, voice, opinions, biographical information and state in any media to promote the Sweepstakes without additional compensation.

By entering, you release, indemnify and hold harmless Sponsor, any sponsor of the Sweepstakes, and each of their respective subsidiaries, affiliates, owners, members, shareholders, directors, officers, employees and agents (“Releases”) from any and all liability for any injuries, loss or damage of any kind, including death, arising from or in connection with the Sweepstakes or receipt or use and/or misuse of any prize.

Sponsor reserves the right to cancel or modify the Sweepstakes if fraud or any other factor impairs the integrity of the Sweepstakes as determined by Sponsor in its sole discretion.

Online entries are deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The “authorized account holder” is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry. Prize will only be awarded to the authorized account holder .

If, in Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if technical difficulties compromise the integrity of the Sweepstakes, Sponsor reserves the right in its sole discretion to void any entries at issue (including disqualifying any individual who tampers or otherwise interferes with the entry process), and to cancel, terminate, modify or suspend the Sweepstakes, in whole or in part, at any time without notice. In the event of such cancellation, Sponsor reserves the right to award prize in a random drawing from all eligible entries received before the time of cancellation. Sponsor in no way promotes illegal acts, and any and all entries which include or promote illegal acts will be disqualified.
Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction of unauthorized access to, or alternation of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry received by Sponsor on account of technical problems or traffic congestion on the Internet or at any website, any combination thereof, or otherwise, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in the sweepstakes.

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

Participants in the Sweepstakes hereby consent to the exclusive jurisdiction and venue of California courts (state and federal) in Los Angeles County for any causes or controversies arising out of the sweepstakes. Winner and any guest of Winner waive any and all objections to jurisdiction and venue in these courts. Entrants hereby agree that any and all disputes, claims, causes of action, or controversies (“Claims”) arising out of or in connection with this Sweepstakes shall be resolved, upon the election by entrant or Sponsor, by arbitration pursuant to this provision and the code of procedures of either the National Arbitration Forum (“NAF”) or the American Arbitration Association (“AAA”), as selected by the entrant. IF ARBITRATION IS CHOSEN BY ANY PARTY WITH RESPECT TO A CLAIM, NEITHER PARTY WILL HAVE THE RIGHT TO LITIGATE THAT CLAIM IN COURT OR HAVE A JURY TRIAL ON THAT CLAIM. FURTHER, NEITHER SPONSOR NOR ENTRANT WILL HAVE THE RIGHT TO PARTICIPATE IN A REPRESENTATIVE CAPACITY ON BEHALF OF THE GENERAL PUBLIC OR OTHER PERSONS SIMILARLY SITUATED, OR AS A MEMBER OF ANY CLASS OF CLAIMANTS PERTAINING TO ANY CLAIM SUBJECT TO ARBITRATION. EXCEPT AS SET FORTH BELOW, THE ARBITRATOR’S DECISION WILL BE FINAL AND BINDING. NOTE THAT OTHER RIGHTS THAT ENTRANT WOULD HAVE IF ENTRANT WENT TO COURT ALSO MAY NOT BE AVAILABLE IN ARBITRATION. The arbitrator’s authority to resolve Claims is limited to Claims between Sponsor and entrant alone, and the arbitrator’s authority to make awards is limited to awards to Sponsor and entrant alone. Furthermore, Claims brought by either party against the other may not be joined or consolidated in arbitration with Claims brought by or against any third party, unless agreed to in writing by all parties. No arbitration award or decision will have any preclusive effect as to issues or Claims in any dispute with anyone who is not a named party to the arbitration.
